Introduction

The site https://www.bioriental.com/ (hereinafter referred to as the “Site”) is an information and electronic commerce site accessible via the Internet network, open to any user of this network (hereinafter referred to as “Internet user” or “Users”).
The User who has validated an order will be called “Customer”. The rights and obligations of the User necessarily apply to the Client.
Any order for a Product offered on the Site requires consultation and express acceptance of these general conditions of sale and withdrawal, manifested by checking the box “I declare that I have read and accept the general conditions of sale Bioriental .”.

ARTICLE 1: OBJECT

The purpose of these general conditions of sale is to define, exclusively, due to the relationships they establish on the Internet, the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.
They regulate all the steps necessary for placing the order and ensure the monitoring of this order between the Parties.
These terms apply to the exclusion of any other document.

ARTICLE 2 – PRODUCTS

The products offered for sale by Bioriental.com are those which appear on the site, on the day the user consults the site and while stocks last.
In the event of unavailability of one of the products, the customer will be informed as quickly as possible.
Photographs and texts illustrating the products do not fall within the contractual scope.

ARTICLE 3 – PRICE

Prices are indicated in Euros and are valid for European Union territories excluding DOM and TOM. They take into account possible reductions as well as French VAT, applicable on the day of the order.

Any order placed on the Site and delivered outside the European Union and to the French overseas departments and territories may be subject to possible taxes, customs duties and other related costs which are imposed when the package reaches its destination. These additional costs are the responsibility of the Customer and are their responsibility.
The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and except for obvious typographical errors or omissions.
The prices indicated do not take into account shipping costs which will be invoiced in addition or offered depending on the amount of the order and the country of delivery, and will be specified to the User upon final validation of their order.
These shipping costs do not include customs and other additional costs which may be requested upon entry into certain countries; these costs remain the exclusive responsibility of the customer.
Bioriental.com reserves the right, which the User accepts, to modify its prices at any time.

ARTICLE 4 – ORDER REGISTRATION AND VALIDATION

4.1 NAVIGATION WITHIN THE SITE

The User can read the different items offered for sale by Bioriental.com on its Site.
The User can freely browse the different pages of the Site without being committed to an order.

4.2 REGISTRATION OF AN ORDER

If the User wishes to place an order, he will choose the different Products in which he is interested, and will express said interest by clicking on the “basket” pictogram.
At any time, the User may:

  • obtain a summary of the Products he has selected, by clicking on the basket.
  • continue or modify your selection of Products by clicking on “Shop”.
  • complete your selection of Products and order these Products by clicking on “Confirm order”.

To order the Products he has thus chosen, after having clicked on “Validate the order”, any User must identify himself, by entering his e-mail address as well as the password which he will have previously chosen during the order. creation of your account, or, if this is your first order, by clicking on “First connection”. In this last scenario, the User must accurately complete the form made available to them, on which they will include the information necessary for their identification and in particular their last name, first name, postal address. 4.3 FINAL VALIDATION OF THE ORDER AND PAYMENT

After having read the status of their order, and once all the requested information has been completed by the User, a summary of this information and the order will appear and the latter must choose the payment method with which he wishes to make his payment to definitively confirm his order.
Orders are payable in euros:

  • by French or international bank card,
  • by Paypal

It is specified that by making an immediate payment by credit card or Paypal, the User will then be automatically switched to the electronic payment server of the secure payment platform. This platform is secured by SSL (Secure Socket Layer) encryption in order to protect all data linked to means of payment, and that at no time will the User's banking data pass through the computer system. from Bioriental.com.
As soon as he validates his payment, the order is recorded. The User becomes a Customer. The order form will be recorded in the computer records of Bioriental.com and will be considered as proof of the contractual relations between the Parties.
In accordance with article 6. below, the Customer has a right of withdrawal and refund, for a period of fourteen (14) working days from the date of receipt of the products.

4.4 MODIFICATION OF AN ORDER

Tracking of orders placed is accessible from the “My Account” menu.
To modify an order, it is necessary to cancel the order, return it to the basket and then correct it as desired before validating it.
Modification or cancellation of an order is only possible when its status is “Registered”.
An order placed in “in preparation” or “shipped” status can no longer be modified.

ARTICLE 5 – DELIVERY

5.1 DEADLINES AND SHIPPING METHODS

Your orders are processed as quickly as possible by the Customer Service and the Shipping Department, open Monday to Friday inclusive.
Orders are prepared upon receipt of payment.

DELIVERY TIME

Shipments take place within 48 working hours following receipt of payment for your order, unless otherwise indicated on the “basket” page.
After delivery by our Shipping Department, your order is delivered according to the time announced on the Site and which varies depending on the Carrier chosen.
These deadlines are in working days, excluding postal delivery problems.

All risks of loss and damage relating to the goods concerned are the responsibility of the customer from the moment the order leaves the Shipping Department and is handed over to the Carrier. However, Bioriental.com undertakes to package the products carefully in order to best avoid possible breakage during delivery.

Bioriental.com is not responsible in the event of a wrong address communicated by the Customer.

5.2 DELAY / ABSENCE OF DELIVERY / LOSS OF PACKAGE DURING TRANSPORT

Our different carriers are reliable services. However, as with any shipment, there may be a delay in delivery or the package may be lost. In the event of a delivery delay of more than 7 days, the Customer must inform Bioriental.com customer service who will transmit the information to the Carrier concerned to trigger the opening of an investigation. If the customer has not notified Bioriental.com within 90 days of the announced date, the complaint may not be taken into account.

PLEASE NOTE: if the customer is not present during delivery or does not collect it from the Carrier chosen within the Carrier's holding period (between 8 and 14 days, depending on the carrier), the package is returned to Bioriental.com .

In this case, Bioriental.com will return the package to the customer (after a written request is made) and the shipping costs of this second shipment will be the responsibility of the customer, even in the event that the Carrier has failed to leave a notice. If no request for reshipment is made within 60 days after receipt of the package at our premises, Bioriental.com will not be obliged to return the package to the Customer.

5.3 ANOMALIES

Any anomaly concerning delivery (damage, open package, damaged package, broken products, etc.) must be indicated on the delivery note in the form of “handwritten reservations”, accompanied by the Customer's signature.

The Customer must report, within a maximum of 7 days, the anomaly to Bioriental.com Customer Service so that a complaint can be made to the Carrier in question, attaching photos of the anomalies, the box and the delivery note.

Bioriental.com will initiate a claim with the carrier and the Customer will be reimbursed as soon as Bioriental.com has been compensated by the carrier.

ARTICLE 6 – RETURN AND RIGHT OF WITHDRAWAL

WITHDRAWAL CONDITIONS

The customer has a right of return of 14 days from receipt of their entire order to withdraw.
To exercise the right of withdrawal, the customer must notify their decision to withdraw their order by an unambiguous written declaration specifying their first and last name, email, address, order number and date:

To exercise his right, the customer must return, at his own expense, the product(s):

  • not used,
  • with clean and intact packaging.

We reserve the right to refuse a refund if one of the 2 conditions notified above is not respected. If the product is lost, stolen or damaged upon return, we cannot be held responsible.

REFUND

Refunds are processed within 14 days from receipt of proof of shipment of the products or failing that, from the date of recovery of the products. Reimbursement is made by reimbursement on the means of payment used or by voucher, if the customer wishes. Failure to comply with the procedure described above and within the deadlines indicated, no refund can be made.

In the event of withdrawal by the customer on his entire order, Bioriental.com will reimburse all payments received from the customer for this order.
In the event of withdrawal by the customer on part of the products in the order, Bioriental.com will reimburse the amount of the returned products.
Bioriental.com may defer this reimbursement until receipt and verification of the products.

ARTICLE 7 – QUALITY GUARANTEE

Bioriental.com guarantees the full conformity of the products displayed in our online store. However, we undertake to provide a refund or exchange if the product is defective or if there is a manufacturing defect or if it does not correspond to what you ordered. In this case, we ask you to inform us of your request in detail (by email) and to return the products that do not correspond to us and according to your choice, a refund or an exchange is scheduled. The request must be made within seven days of receipt of the package, otherwise your request will not be taken into account.

The shipping costs incurred by returning the package will be reimbursed to you at the “Colissimo followed without signature” rate from La Poste.

ARTICLE 8 – COMPUTING AND FREEDOMS

The provision of personal information collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential and is not transmitted to third parties.
In accordance with article 34 of the law of January 6, 1978, the Customer has the right to access, modify, rectify and delete data concerning him.

ARTICLE 9 – DISPUTES

This contract is subject to French law. Bioriental.com cannot be held responsible for damages of any nature, whether material, immaterial or bodily, which could result from the misuse of the products sold.
In the event of difficulties in the application of this contract, the customer has the possibility, before any legal action, to seek an amicable solution in particular with the help of a professional association of the sector, a consumer association or any other advice of his choice.
Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer will contact the company as a priority to obtain an amicable solution.
In the absence of an amicable agreement between the parties, the dispute will be submitted to the French courts, unless otherwise provided by law.
